TERMS AND CONDITIONS OF SALE

1. TERMS AND CONDITIONS

The supply of all goods by Lincraft shall be subject to these Terms and Conditions, whether in the past, present, or future. These Terms and Conditions take precedence over any other terms, including those implied by statute, to the extent permitted by law. The Applicant acknowledges having read and understood these Terms and Conditions of Sale prior to signing this Application for a Credit Account.

2. CREDIT TERMS

Full payment must be made within 30 days of receipt of goods. If full payment is not received within this period, Lincraft reserves the right to withdraw credit and cease supply. Interest may be charged at a rate of 15% per month or part thereof on any outstanding amounts, calculated from the date of delivery.

3. DISPUTES

Any disputes with Lincraft will be governed by the laws of the State of Victoria and subject to its courts’ jurisdiction.

4. WITHDRAWAL OF CREDIT

Lincraft reserves the right, at its sole and absolute discretion and without providing reasons, to withdraw any credit facilities granted, without prior notice.

5. DEFAULTS

If the Applicant defaults on any payments owed to Lincraft under these Terms and Conditions of Sale, all outstanding amounts (invoiced or otherwise) become immediately due and payable. The Applicant agrees to indemnify Lincraft against all costs incurred as a result of the default, including but not limited to solicitor fees (on a solicitor–client basis), commercial agent commissions, freight, insurance, loss of profit, and interest.

6. PAYMENT

Lincraft may, at its sole and absolute discretion, allocate any payments received from the Applicant toward any amounts owed by the Applicant, regardless of whether the Applicant specifies otherwise.
