Lincraft GOLD Membership Terms & Conditions

  1. 1. Subscription Agreements
    1. 1. This Lincraft Gold user agreement is between you and Lincraft Australia Pty Ltd (referred to in this Agreement as "we", "us" or "our") ("User Agreement"). These terms and conditions govern your purchase and use of a paid renewable membership service (“Lincraft Gold Membership”) providing you access to benefits on www.lincraft.com.au.
    2. 2. By selecting and purchasing your Lincraft Gold membership, you are agreeing to an ongoing subscription service to receive the benefits set out in this User Agreement, as modified from time to time, and billed in advance monthly or 6 monthly, depending on the type of subscription you select and purchase.
    3. 3. Subscriptions are limited to a single user account and are not transferable.
    4. 4. We may refuse any subscription at our discretion. Where we refuse a subscription (at or within a reasonable time after the subscription date), you will be provided with a full refund.
    5. 5. Lincraft Gold is only valid for one delivery address. You cannot change addresses more than once every 6 months.
  2. 2. Monthly Subscription
    1. 1. A monthly subscription entitles you to receive full Lincraft Gold member benefits set out in clause 4 for the month following the date of your subscription.
    2. 2. Monthly subscriptions will be automatically renewed unless cancelled by you prior to the renewal date. The renewal date is the one-month anniversary of your subscription date or previous renewal date.
    3. 3. Monthly subscriptions can be upgraded to a 6 monthly subscription at any time.
  3. 3. 6 Monthly Subscription
    1. 1. A 6 monthly subscription entitles you to receive full Lincraft Gold member benefits set out in clause 4 for 6 months from the date of your subscription.
    2. 2. 6 Monthly subscriptions will be automatically renewed unless cancelled by you prior to the renewal date. The renewal date is the 6 month anniversary of your subscription date or previous renewal date.
  4. 4. Lincraft Gold Member Benefits
    1. Being a Lincraft Gold member entitles you to the following member only benefits on Lincraft.com.au:
    2. 1. Free standard delivery on eligible products for eligible goods sold by Lincraft but excluding shipping fees for Rug purchases. 
    3. 2. A $20 voucher for your birthday if you provide your date of birth and valid email address. This is conditional upon you opting in to receive our EDM’s. (Electronic Direct Mail)
    4. 3. An extra 10% discount on all purchases but excluding storewide/sitewide % off sales.
    5. 4. Lincraft Gold subscriber-only discounts and benefits on certain goods sold on www.lincraft.com.au.
  5. 5. Cancelling Your Subscription
    1. 1. You can cancel your Lincraft Gold subscription at any time by contacting our customer service team.
    2. 2. Your cancellation will take effect from the end of your then current subscription period.
  6. 6. Modification and Termination and Fair Use
    1. 1. We reserve the right to:
      1. 1. Modify or change the benefits of the service at any time;
      2. 2. Alter any fees charged for the Lincraft Gold service. Changes to fees will only take place when your subscription renews for another month or 6 months.
    2. 2. We will notify you of any changes, and you may cancel your subscription prior to such changes taking place. If the change negatively affects your use or benefits of the service, we will refund your subscription fee for the then current subscription term.
    3. 3. Your continued use of Lincraft Gold after a notification of any change is made will constitute your acceptance of any such changes. If you do not agree to the changes, you may cancel your subscription either prior to making a Lincraft Gold purchase, or within 14 days, whichever occurs first, by contacting our  customer service team.
    4. 4. Fair Use policy and breach: Where we suspect that you are abusing your member benefits by, for example, sharing your account with existing users, placing multiple or excessive single item orders or otherwise engaging in conduct is an abuse of your member benefits, or a breach of these terms and conditions, we may cancel your membership. Where we revoke a membership subscription for misuse or breach of these terms and conditions, subscription fees are not refundable.
    5. 5. We also reserve the right to terminate your subscription at any time, without notice if we choose to stop providing the services. In such circumstances, you will be provided with a full refund of your subscription fee.
  7. 7. Limitation of Liability
    1. In addition to the limitations, exclusions, indemnities and disclaimers in our standard terms and conditions, to the maximum extent permitted by law (including the Australian Consumer Law) in no event shall we, or any of our officers, directors, employees, agents or representatives be liable to you or any third party for any loss or damage arising from or connected to your Lincraft Gold subscription, including any direct, indirect, special, punitive or consequential damages or losses, or any other costs, losses or damages or any kind related to this agreement. Our liability (whether in tort or contract) is, at a maximum, limited to the subscription fees paid by you for the current or latest subscription period.
  8. 8. Recurring Payments
    1. 1. When you purchase a Lincraft Gold membership, you agree to pay us a recurring payment as changed from time to time in accordance with this User Agreement (“Recurring Payment”). You are responsible for paying all Recurring Payments incurred under your Lincraft Gold membership. The applicable Recurring Payment is in Australian Dollars and inclusive of GST and applicable taxes where required by law. You authorise us to charge the Recurring Payment for your first Billing Cycle, monthly or 6 monthly, to your nominated payment method on the anniversary of your subscription, which will activate your Renewable Membership. Your Billing Cycle commences on Your Billing Day, being the date and anniversary date that your subscription starts and expires at midnight on the day prior to Your Billing Day in the subsequent calendar month or 6 months.
    2. 2. Unless you cancel your Lincraft Gold membership, it will automatically renew at the end of your Billing Cycle for a further Billing Cycle. You authorise us to automatically charge, on Your Billing Day, the Recurring Payment to your nominated payment method for each subsequent Billing Cycle. If you do not want your Lincraft Gold membership to automatically renew, you can cancel your Lincraft Gold membership in accordance with Clause 5 of this User agreement.
    3. Lincraft vouchers, credit notes and Buy Now, Pay Later are not accepted as payment methods for your Lincraft Gold membership.
  9. 9. Declined Payments
    1. If your selected payment method is declined, we will prompt you for a new payment method. However, we reserve the right to terminate your Lincraft Gold membership for any unpaid Billing Cycles with no further charges to you.You are responsible for any fees charged by the provider of your payment method (for example, the bank you have a payment card with) including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross border fees, or other fees levied by the provider of your payment method.
  10. 10. Consumer Law
    1. Nothing in this agreement is intended limit or adversely affect any right which cannot be waived under the Australian Consumer Law.
